r AUG 0 9 1990 <br />the required comprehensive plan submittal date land development <br />regulations consistent with the adopted comprehensive plan be <br />adopted or amended. Since the county's required submittal date was <br />September 1, 1989, the land development regulations are required <br />to be adopted by September 1, 1990. <br />In rewriting the land. development regulations, the Community <br />Development Department has coordinated with the County Attorney's <br />Office. The result of this coordination is a proposed reformat of <br />the county's entire Code of Laws and Ordinances to a unified Code <br />Book (proposed outline of the new county code is enclosed). The <br />Attorney's office is responsible for titles I through VII, and the <br />Community Development Department is responsible for title VIII <br />(comprehensive plan), and title IX (Land Development Regulations). <br />Since January, the Community Development Department has held <br />workshop meetings every Thursday, from 9:00 a.m. to 12:00 noon, to <br />solicit public input on the rewrite of the land development <br />regulations. A questionnaire was prepared and mailed to the members <br />of the public whose names were included in the workshop <br />participation list. An article published in the Press Journal <br />explained the workshop process, schedule, and encouraged public <br />participation (a copy of questionnaire and workshop schedule is <br />enclosed). <br />Attached to this agenda item are drafts of 32 of the 34 chapters <br />which constitute the set of land development -regulations for the <br />County. These draft chapters have been reviewed in workshops and <br />have been revised to reflect workshop comments as well as comments <br />received from other county departments and interested individuals. <br />The two chapters not included are still in initial draft stages, <br />but these will be completed and workshopped prior to the final <br />adoption hearing, for the land development regulations, scheduled <br />for September 11, 1990. <br />ALTERNATIVES & ANALYSIS <br />In preparing these land development regulations, the staff used <br />existing codes and ordinances as much as possible. While some <br />ordinances such as the sign code have been substantially revised <br />within the last several years and only required reformatting and <br />minor changes, other chapters such as concurrency management, <br />wellfield protection, upland habitat protection and several others <br />are completely new. For this 'reason the draft land development <br />regulations are a combination of existing regulations and new <br />initiatives. - <br />Besides complying with the state mandate to enact revised land <br />development regulations, the staff had several other objectives for <br />the project. These were to make the new land development <br />regulations consistent with the adopted comprehensive plan, make <br />the new land development regulations easy to use and understand, <br />and correct problems in the existing code. Toward this end, the <br />staff critically assessed existing codes, identified comprehensive <br />plan mandated regulations, researched regulatory alternatives, and <br />obtained public input. The result is the draft set of land <br />development regulations attached to this item. <br />The staff will address each chapter in more detail at the workshop <br />meeting. This will include a brief statement of changes, new <br />initiatives, and controversial issues relating to each chapter. <br />RECOMMENDATION <br />The staff recommends that the Board of County Commissioners review <br />the draft material and consider the drafts at the workshop meeting. <br />I <br />
