Collins II, Assistant County Attorney <br />DATE: August 14, 1990 <br />RE: Potential Approaches towards Settlement with <br />DCA Over Comprehensive Plan Noncompliance <br />Discussions with the DCA staff and recent correspondence <br />from Secretary Pelham have indicated that DCA will do no <br />negotiating toward a settlement on the issue of our Plan's <br />noncompliance until such time as some concrete proposals are <br />submitted to them. They have characterized our efforts to <br />date as an attempt to justify our position rather than an <br />attempt to remedy the deficiencies DCA has pointed out. <br />Principle Issues Raised by DCA: <br />1. Inconsistency with the Treasure Coast Regional Planning <br />Council Native Upland Vegetation Rule. <br />2. Allocating 11.6 times more land area for urban <br />development than is projected to be needed over the <br />next 20 years. <br />3. Agricultural densities at 1 unit per 5 acres not <br />advancing the state goal to preserve productive <br />agricultural land use. <br />RECOMMENDATION: I would suggest that you authorize the <br />Chairman, Administrator, Planning Department, and Attorney's <br />Office to forward the following proposals to DCA in an <br />attempt to work out a settlement agreement over our <br />Comprehensive Plan before the September 9th break -off date <br />in negotiations. <br />A) Preserve pine flatwoods through acquisition or other <br />means, to address the Treasure Coast objection to our <br />native upland vegetation protection policies. <br />B) Roll back the 25% Increase in urban population <br />allocations under the new plan. Return to the land <br />uses in our plan, as it existed in 1985, for the urban <br />fringe areas. <br />C) Propose ten -acre agricultural zoning west of 1-95 (with <br />the exception of the immediate area around Fellsmere) <br />with the further provision of the possibility of <br />transfer of development rights into the "roll back" <br />area (See B above) along with other rural preservation <br />techniques as may be suggested by our Planning <br />Department. <br />83 <br />
