SEP 04 1990 <br />ALTERNATIVES AND ANALYSIS: <br />Section 13-21(a), Public Nuisances, of the- Code of Laws and Ordinances of <br />Indian River County specifically reads as follows: <br />"After abatement of a nuisance by the County, the cost thereof to the <br />County as to each lot, parcel or tract of land shall be calculated and <br />reported to the Board of County Commissioners. Thereupon, the Board of <br />County Commissioners, by resolution, shall assess such casts against such <br />lot, parcel, or tract of land... Such resolution shall describe the land <br />and state the cost of abatement, which shall <br />include <br />an administrative <br />cost of seventy-five dollars ($75.00) per <br />lot. <br />Such assessment shall be a legal, valid, <br />and <br />binding <br />obligation upon the <br />property against which made until paid. <br />The assessment shall be due and <br />payable thirty (30) days after the mailing <br />of a <br />Notice <br />of Assessment, <br />after which interest shall accrue at the rate of <br />twelve <br />(12) per cent per <br />annum on any unpaid portion thereof." <br />Cost for equipment use and labor, as indicated by the Road & Bridge Division, <br />plus the $75.00 administrative cost, calculates to be: <br />Labor: $ 342.88 <br />Equipment: $ 288.96 <br />Administrative Fee: $ 75.00 <br />Total: $ 706.84 <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners adopt the proposed <br />resolution assessing $ 706.84 in abatement cost, in accordance with Section <br />13-21(a), of the Indian River County Code of Laws and Ordinances. <br />ON MOTION by Commissioner Wheeler, SECONDED by <br />Commissioner Scurlock, the Board unanimously adopted <br />Resolution 90-101, assessing costs of County Public <br />Nuisance Abatement on Vero Beach Homesites Subdivision <br />Unit No. 1, Lots 9 & 10, Block A; such assessment being <br />a binding obligation upon the property until paid. <br />ASSESSMENT ROLL IS ON FILE IN THE OFFICE OF THE CLERK TO THE <br />40 <br />
