r V C <br />- <br />SEP 04 1994 Qqr FAJJ <br />DESCRIPTION AND CONDITIONS <br />Land development permit No. 072 was issued on January 23, 1989 to <br />Vero Building Corporation to construct a 20.45 acre 42 lot <br />subdivision including a 9.3 acre multi -family tract. Colonial <br />Gardens Subdivision is located along the north side of 9th Street <br />between Old Dixie Highway and Hibiscus Air Park. Because <br />construction has not been completed, the permit expired on July 23, <br />1990, 18 months after the approval ..date. The applicant has <br />submitted a written request for an extension of the permit. <br />ALTERNATIVES AND ANALYSIS <br />The Utilities Services Department staff has indicated that the <br />project's current Utilities Construction Permits for water <br />distribution, and wastewater collection and transmission would not <br />need any modifications for an extension of the Land Development <br />Permit. <br />The Community Development Department staff has requested that the <br />following two conditions of the concurrently expired Land Clearing <br />and Tree Removal Permits be included as conditions of the <br />extensions of the Land Development Permit: <br />1. Right-of-way and easement areas to be cleared shall be clearly <br />staked and verified by county environmental planning staff <br />prior -to clearing commencement. <br />2. Debris shall be removed to an approved disposal facility or <br />burned with Division of Forestry approval. <br />The Land Clearing and Tree Removal Permits would automatically be <br />extended with the Land Development Permit. <br />Alternate No. 1 <br />Grant extensions of the Land Development Permit and Land Clearing <br />and Tree Removal Permits with the conditions described above, and <br />that the permit extension will expire in 18 months if construction <br />is not complete. <br />Alternate No. 2 <br />Deny extension and require the developer to submit new applications <br />and review fees for land development, land clearing and tree <br />removal permits. <br />RECOMMENDATION <br />Staff recommends approval of Alternate No. 1. <br />ON MOTION by Commissioner Scurlock, SECONDED by <br />Commissioner Wheeler, the Board unanimously approved <br />staff's recommendation of Alternate #1 as set out in <br />the above memo. <br />57 <br />
