McCoytent <br />Staff Planner Development <br />DATE: August 27, 1990 <br />SUBJECT: JOHN TANASE'S REQUEST FOR EXTENSION OF A SITE PLAN <br />APPROVAL <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at its regular <br />meeting of September 18, 1990 <br />DESCRIPTION AND CONDITIONS: <br />In 1989 the Planning and Zoning Commission approved a major site <br />plan application submitted by John Tanase. Approval was given to <br />construct a 9,120 sq. ft. office building at 1205 South U.S. <br />Highway 1. <br />Due to financial constraints, Mr. Tanase has been unable to <br />commence construction prior to the expiration of the approved site <br />plan. Since no construction was begun by the expiration date, the <br />site plan approval will lapse unless otherwise extended by the <br />-- Board of County Commissioners. The applicant did submit a request <br />for site plan extension prior to the expiration date. Therefore, <br />in accordance with the site plan ordinance, it , the Board of County <br />Commissioners may act on this request. <br />Since the project has been approved.,a sewer force main has been <br />constructed along south U.S. #1, making sewer available to the <br />project. As a condition of the site plan extension, the utilities <br />department is requiring the applicant to connect to county sewer. <br />It should be noted that as part of his original site plan <br />application, the applicant acknowledged that he would be required <br />to hook up to sewer when it became available. The sewer connection <br />requirement is the only change that has occurred with the site <br />plan. The 'applicant agrees to the sewer connection requirement <br />(see attachment #4). <br />Pursuant to the provisions of the site plan ordinance, *John Tanase <br />is requesting a full 1 -year extension of the approved site plan. <br />It has been the policy of the Board to grant extensions to projects <br />which conform to current codes. <br />RECOMMENDATION: <br />Staff recommends approval of John Tanase's request for a one year <br />extension of the approved site plan; the new expiration date to <br />be May 25, 1991, subject to the following condition: <br />1. that the applicant submit and obtain a utility construction <br />permit for the required connection to county sewer, prior to <br />site plan release and that the sewer connection be completed <br />and in service, prior to the issuance of a certificate of <br />occupancy (C.O.) for the project. <br />
