BOOK 81 ['Au <br />2. From a decision of a. County Officer. Any personi <br />aggrieved by a final decision of a County Officer may;, <br />appeal to the Board of County Commissioners within ten! <br />working days of the final decision. The Board shall; <br />respond within 20 working days. <br />3. From a decision.of a Chapter 400 board or commission. <br />Any person aggrieved by a final decision of a board or <br />commission : may appea.i to the ' Board of County <br />Commissioners within twenty working days of the final <br />decision. The Board of County Commission.shaii respond <br />within twenty working days. <br />4. From a decision of the Board of County Commissioners. <br />There is no right of appeal from a final decision of <br />the Board of County Commissioners. <br />5. Failure on.the part of the appellant to comply with the' <br />procedures as set forth in Paragraphs (a) thru (d). <br />above shall constitute a waiver of the right to appeal. <br />Failure on the part of the .appellee to comply with <br />these same procedures shall be deemed a denial of the <br />appeal.. <br />Section 100.07 Severability of Parts of Code <br />This code shall be severable, i.e, if any part is held to be <br />unconstitutional the remainder shall remain in fall force, <br />and effect. <br />Chairman Eggert read aloud the title of the proposed <br />ordinance for establishing Chapter 101 - Government Organization <br />of the Code of Indian River County. <br />Chairman Eggert opened the Public Hearing on Chapter 101, <br />and asked if anyone wished to be heard in this matter. There <br />being none, she closed the Public Hearing. <br />ON MOTION by Commissioner Bird, SECONDED by <br />Commissioner Scurlock, the Board unanimously adopted <br />.Ordinance 90-18, establishing Chapter 101, Government <br />Organization; providing repeal, providing <br />severability; and providing an effective date. <br />32 <br />
