Commi.ssioner Scurlock understood that there are interveners <br />in this matter, both for and against our Comp Plan, and Attorney <br />Collins explained that right now, Attorney Bruce Barkett's <br />clients have intervened on the County's behalf saying that the <br />plan should be found in compliance. It is entirely possible that <br />the interveners may feel differently about these remedial amend- <br />ments, and they should have the opportunity to propose some <br />compliance amendment that would be acceptable to all parties. <br />Commissioner Bird asked at what point in the process if the <br />Board asked whether we agree or disagree with the interveners' <br />positions, and Attorney Collins explained that the Board can make <br />their comments at the transmittal process when you send it up to <br />the DCA. He felt it is meaningful to hear what they say, but it <br />wouldn't do us a lot of good to say that we agree with an <br />intervener now and then have the DCA reject it,.because we would <br />be right back at the same point. If the DCA supports the <br />interveners' positions, we will have another opportunity at the <br />adoption hearing to consider them ourselves either favorably or <br />unfavorably, and we would have the opportunity to argue for it. <br />Chairman Eggert understood that if we approve this <br />compliance agreement tonight, we are not completely out of the <br />administrative hearing process -- it simply puts it off. If for <br />some reason the DCA decides that the County was proceeding in.bad <br />faith in our process, they could demand an administrative hearing <br />to start anytime on everything that is in here, not just one or <br />two things. Until we get through the last adopted amendment, we <br />still will have an administrative hearing hanging over us. <br />Attorney Collins advised that the interveners have an <br />opportunity to be heard through the administrative hearing <br />process. We did a deposition on Monday and most of the <br />interveners were represented.
