UPCHURCH <br />Re: Potential for Settlement of Claims of Intervenor Coraci, <br />et al. <br />Dear Will <br />Pursuant to the conversations that we had during the <br />depositions on Monday, Sam OwensI later conversations with the <br />Secretary of Community Affairs, and our conversations this morning <br />with David Russ and yourself, we believe that there i.s.a potential <br />solution to the plan challenge of this intervenor, and we would <br />appreciate your informing your commissioners of the proposal at <br />this evening Is hearing. I recognize that the commissioners are not <br />going to have enough information to make any decisions this <br />evening, but it will be helpful to the negotiations if you receive <br />a general expression of interest or disinterest in this proposal. <br />The County will recall that it had originally assigned a <br />density of 1 t 1 to the ridge portion of the property west of the St. <br />Sebastian River, with provisions for transferrable development <br />rights. This property was placed in the land use classification <br />C-21 although it is the only dry scrub area within that <br />classification= the remaining C-2 lands are principally wetlands <br />along or within the Indian River. The Department suggested that <br />the densities should be reduced to 1:40 on lands in the C-2 <br />classification, but we have discovered that the only apparent <br />factual basis for that recommendation is the comment from the Water <br />Management District. That comment was limited to wetlands and deep <br />water habitats, and does not appear relevant to the Coraci lands. <br />S 1\CWATf \309100J <br />24 <br />
