Collins, II, Esquire <br />Page 3 <br />September 26, 1990 <br />of Claims in Florida Mock Industries v. united States (copy <br />enclosed) cast doubt on the use of regulation rather than purchase <br />to preserve native communities, when development is not itself a <br />nuisance. While we are certainly willing to negotiate with the <br />state agencies, we .should be entitled to a fair price which <br />re€-.ects the true development potential of the land. <br />In our discussions with counsel for the Department of <br />Community Affairs, he pointed out that a plan amendment to dispose <br />of this intervenor's challenge should be entirely separate from the <br />package of amendments previously negotiated with the Department as <br />a compliance agreement. Nevertheless, this amendments if it is <br />favorably received by the County, should be transmitted at the same <br />time if the administrative hearing is to be abated. Although we <br />certainly do not expect to conclude a "deal" with Indian River <br />County or with the Department of Community ,Affairs on such short <br />notice and without opportunity for full public notice and hearing, <br />we will consider the County Commissioners' instructions to you to <br />proceed with negotiations in this general direction to be a sign <br />of good faith, based upon which we would withdraw our insistence <br />that the administrative hearing proceed on these intervenors' <br />claims as scheduled on October 9. <br />Please feel free to call either me or Bob Riggin if you have <br />any questions raised by this letter.
