Attorney Lloyd advised that after some of the other <br />neighbors questioned the screening of the pergola, the Community <br />Design Committee did make some modifications to the pergola, <br />changing it from screening to louvers. <br />Commissioner Bird asked Attorney Vitunac what latitude the <br />Board has on this special exception, and Attorney Vitunac advised <br />that the Board can approve it with conditions designed to <br />ameliorate the major negative effects of it, if any. It is the <br />applicant's burden to show that he has met all the specific <br />criteria of the ordinance and at least cover the general <br />criteria; then the burden of proof is on the County Commission to <br />say why they would deny it. <br />Attorney Lloyd objected to calling this all one thing. The <br />greenhouse is 1191 square feet, and the ancillary structures can <br />be constructed without any special approval. The point is that <br />they are here today on the greenhouse and the ancillary <br />structure, as far as the workshop or whatever that is on the <br />house is concerned, can be built without any special approval. <br />The greenhouse was attached to that because of the requirements <br />of the ordinance. <br />Chairman Eggert emphasized.that this is special exception <br />and we can attach certain conditions. <br />Attorney Vitunac advised that the Board has the right to <br />reduce the'size of this structure under certain findings, and <br />Director Boling explained that a pergola is not defined in our <br />ordinance. Staff is looking at all of it together as related to <br />the greenhouse structure itself, and we are talking about 2200 <br />square feet because the tool shed is actually attached to the <br />greenhouse structure and the pergola comes right off of that. As <br />you can see in the diagram, they are connected. <br />Commissioner Bowman was concerned about the stormwater - <br />run-off going <br />into the river, and Attorney Lloyd <br />explained <br />that <br />there will be <br />a 5" pipe running under the wall to <br />carry the water <br />OCT 2199® <br />40 <br />�� ��� <br />FA I U..JL <br />
