DEVELOPMENT ORDER <br />APPROVAL <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at its regular <br />meeting of October 16, 1990. <br />BACKGROUND: <br />At its regular meeting of September 25, 1990, the Board of County <br />Commissioners considered requests to approve a comprehensive plan <br />amendment, rezoning, and DRI development order (D.O.) to allow the <br />development of the proposed Indian River Mall. The Board <br />considered all three requests as "one package". In considering the <br />proposed D.O. for the mall project, the Board made some additions <br />and a few relatively minor modifications to staff's original <br />proposal. However, the applicant (the Edward J. DeBartolo <br />Corporation) expressed concerns over four issues and requested a <br />continuation of the proceedings to allow time to develop acceptable <br />alternatives -and to work further with staff. The Board voted to <br />continue the proceedings for three weeks, until the October 16, <br />1990 regular meeting. The Board is now to again consider the <br />adoption of a D.O. and conclude its action on the corresponding <br />comprehensive plan amendment and rezoning requests. <br />ANALYSIS: <br />Under the D.O. proposed at the September 25th meeting, the <br />applicant's four areas of expressed concern were: <br />Concern #1. A drainage condition requiring filtration through <br />grass swales within the parking area. [4/25/90 <br />PACKET CONDITION #18] <br />Concern #2. The absence of a condition that would allow the <br />applicant to submit a traffic improvements "staging" <br />plan which would be approvable by County, Treasure <br />Coast Regional Planning Council and Florida <br />Department of Transportation staff. <br />42 <br />
