McCoy 00,/Z-. �FGi �- <br />Staff Planner, Current Development <br />SUBJECT: MARIA STEWART REQUEST TO ABANDON A PORTION OF 44TH <br />STREET, WEST OF 35TH AVENUE <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at its regular <br />meeting of October 23, 1990. <br />DESCRIPTION AND CONDITIONS: <br />Maria Stewart has submitted a petition for the abandonment of a <br />portion of 44th Street, west of 35th Avenue. <br />Per guidelines established by the Board of County Commissioners, <br />the petition was reviewed by all county divisions and utility <br />providers having jurisdiction within the right-of-way. All <br />reviewing agencies have recommended approval of the abandonment, <br />with the provision that a 40' drainage and utilities easement be <br />retained. The easement is to be centered in the abandoned right- <br />of-way. <br />ight- <br />of-way. <br />This portion of 44th Street is not part of the roadway system as <br />noted on the County Thoroughfare Plan, and is not needed for the <br />thoroughfare system. The right-of-way is currently maintained by <br />the applicant as a lawn. The abandonment will not.deny access to <br />any property owner. <br />RECOMMENDATION: <br />Staff recommends that the County abandon its rights to 44th Street <br />and that the Chairman of the Board of County Commissioners be <br />authorized to execute the attached resolution (Attachment #3), with <br />the condition: <br />1. that a 40' drainage and utilities easement. be retained in <br />the center of the subject right-of-way. <br />The Chairman asked if anyone present wished to be heard. <br />There were none, and she thereupon closed the public hearing. <br />ON MOTION by Commissioner SCUrlock, SECONDED by Com- <br />missioner Wheeler, the Board unanimously (4-0) adopted <br />Resolution 90-159 abandoning a portion of 44th St. west <br />35th Avenue as requested by Maria Stewart subject to the <br />condition recommended by staff. <br />31 <br />
