McCoy. <br />Staff Planner, Current Development <br />September 7, 1990 <br />SUBJECT: SUSAN GIEROCK'S REQUEST TO ABANDON A PORTION OF 88TH <br />COURT, SOUTH OF 22ND STREET <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at its regular <br />Meeting of October 23, 1990. <br />DESCRIPTION AND CONDITIONS: <br />Susan Gierock has submitted a petition for the abandonment of a <br />portion of 88th Court, south of 22nd Street. <br />Per guidelines established by the Board of County Commissioners, <br />the petition was reviewed by all County divisions and utility <br />providers having jurisdiction within the right-of-way. All <br />reviewing agencies have recommended approval of the abandonment, <br />with the provision that the entire right-of-way be retained as a <br />drainage and utilities easement. While the County is retaining the <br />entire portion of the subject right-of-way as an easement, the <br />property owners will benefit by being able to build in the old <br />setbacks and use the easement (abandoned right-of-way) for setback <br />purposes. <br />This portion of 88th Court is not part of the roadway system as <br />noted on the County Thoroughfare Plan, and is not needed for the <br />thoroughfare system. The right-of-way is currently undeveloped and <br />stubs out to a right-of-way portion previously abandoned in 1972 <br />(Please see attached graphic). The abandonment will not deny <br />access to any property owner. <br />RECOMMENDATION: <br />Staff recommends that the County abandon its rights to 88th Court <br />and that the Chairman of the Board of County Commissioners be <br />authorized to execute the attached resolution (Attachment #3), with <br />the condition: <br />1. that drainage and utilities easement be retained over the <br />entire subject right-of-way. <br />The Chairman asked if anyone present wished to be heard. <br />There were none; and she thereupon closed the public hearing. <br />
