Keating, AICP �M <br />Community -.Development Director <br />DATE: October 15, 1990 <br />SUBJECT: CONCURRENCY <br />It is requested that the data herein presented be given formal <br />consideration by the board of county commissioners at their regular - <br />meeting of October 23, 1990. <br />DESCRIPTION & CONDITIONS <br />Probably the most far-reaching aspect of the 1985 growth management <br />act is the concurrency requirement. Mandating that adequate <br />facilities be provided to accommodate the impacts of development <br />projects at adopted levels of service, concurrency has produced <br />moratoriums in several local governments in the state. <br />With the recent adoption of its land development regulations, <br />Indian River County is now beginning to. formally implement <br />concurrency. Based upon state requirements, the Indian River <br />County concurrency ordinance (Chapter 910 of the land development <br />regulations) establishes procedures for implementing concurrency <br />and criteria for reviewing concurrency certificate requests. The <br />county's concurrency review criteria was structured to correspond <br />to state requirements. As such, the county can implement <br />concurrency by taking a strict approach or a more liberal approach. <br />The most restrictive approach to concurrency involves requiring <br />that facilities be in place prior to approving a development order <br />for a project. The least restrictive approach involves issuing <br />development orders when facilities are included in the County's <br />capital improvements program. The applicable state law, section <br />9J-5.0055, FAC, (a copy of which is attached) allows local <br />governments to implement concurrency using a range of approaches <br />between the two extremes. <br />Concurrency Requirements Table <br />To more clearly identify concurrency requirements and options, <br />staff has prepared the attached concurrency requirements table. <br />The table is structured to correspond to the three types of <br />concurrency certificates established in the Indian River County <br />concurrency management ordinance.
