Commissioner Bird suggested that we tell Dr. Norris that we <br />are giving them first option to lease the building at market <br />value and ask them to come back to us with a proposal. That way, <br />we would be putting the ball in their court as to what terms they <br />would like and the amounts, and then have that proposal backed up <br />with appraisals or whatever means are needed to justify their <br />cost. <br />Commissioner Bowman suggested that we also approach the <br />School Board on this matter. <br />THE CHAIRMAN CALLED FOR THE QUESTION. The Motion <br />was voted on carried unanimously. <br />INDIAN RIVER COUNTY LIBRARIES INTERIOR DESIGN CONTRACT <br />The Board reviewed the following memo dated 10/24/90: <br />DATE: OCTOBER 24, 1990 <br />TO: HONORABLE BOARD OF COUNTY COMMISSIONERS <br />THRU: JAMES E. CHANDLER <br />COUNTY ADMINISTRATOR <br />FROM: H.T. "SONNY" DEAN, DIRECTOR <br />DEPARTMENT OF GENERAL SERVI S <br />SUBJECT: INDIAN RIVER COUNTY LIBRARIES <br />INTERIOR DESIGN CONTRACT <br />BACKGROUND: <br />On December 22, 1989, the Board of County Commissioners entered into <br />a contract with Dow, Howell, Gilmore, and Associates, Inc., to <br />perform interior design services for the two new libraries. This was <br />a supplement authorization for professional services to the original <br />contract with this firm to design the Main Library. A fixed maximum <br />amount of $44,190.00 was agreed too. <br />When the monthly billings for work performed totaled the $44,190,00, <br />this writer denied further payment. Mr. Jim Howell of the firm,; <br />telephoned and stated that Reimbursable Expenses were not part of the <br />maximum amount and should be paid in addition. Since, we did not <br />agree with interruption of the contract, I informed Mr. Howell that <br />this matter would be turned over to our legal staff for an opinion. <br />Based on their opinion I would take action accordingly. z <br />On September 28, 1990 Terry O'Brien, Assistant County Attorney, wrote <br />an opinion that was in agreement with my interruption of the ~` <br />contract. The total maximum amount to be paid to the architect would <br />not exceed $44,190.00. Based on this opinion, a letter with a copy <br />of the attorneys opinion was sent to Mr. Howell confirming our <br />posiition. <br />On October 18, 1990, Jim Howell wrote a letter appealing staff's <br />position in this matter. Based on the original contract, supporting <br />documents, and the extent of work they have performed, he felt they <br />were entitled to payment for Reimbursable Expenses. <br />RECOMMENDATIONS: <br />As per the letter of appeal, all information pertinent to this <br />situation is attached for Board review and final determination. <br />49 <br />V 1990 _ IROCK . �A,cb:lo <br />
