3. Notice of the intention of the County Commission to vacate the <br />plat must be published in a newspaper of general circulation <br />in the county in not less that two weekly issues of the paper. <br />4. The proof of publication of. the petition for vacation must be <br />attached to the petition. <br />5. Certificates showing that all state and county taxes have been <br />paid must be provided. <br />The proposed vacation does include the park tract within the <br />subdivision. The County Attorney's Office has indicated that all <br />remaining lot owners in the subdivision have an implied easement <br />for the use of the subject park tract. The Attorney's Office has <br />required the applicant to obtain consent and joinders from all <br />remaining lot owners in the subdivision in order to extinguish the <br />implied easement and clear the way for the vacation to proceed. <br />Recently, the applicant provided such consent and joinders from the <br />individual lot owners to the Attorneys Office. Thus, the <br />Attorney's Office concerns regarding the park tract have been <br />satisfactorily addressed. <br />The applicant has submitted all of the above information which has <br />been reviewed and approved by the county staff, including the <br />County Attorney's Office. Furthermore, all state requirements <br />concerning plat vacation have been met. Therefore, County staff <br />have no objections to the requested vacation. <br />RECOMMENDATION <br />Staff recommends that the Board of County Commissioners adopt the <br />attached resolution vacating all of Block 1, lots 1-8 in Block 2, <br />and the park tract of the Gloria Gardens plat as recorded in plat <br />book 51 page 33 of the Public Records of St. Lucie County, Florida, <br />said land now lying and being in Indian River County, Florida. <br />Chairman Eggert opened the Public Hearing, and asked if <br />anyone wished to be heard. There being none, she closed the <br />Public Hearing. <br />ON MOTION by Commissioner Wheeler, SECONDED by <br />Commissioner Bowman, the Board unanimously adopted <br />Resolution 90-170, vacating, in -part, the plat of <br />Gloria Gardens. <br />23 1110N 1 <br />Nov 2 0199Q - � <br />
