Finney, SRA T` <br />Right -of -Way Acquisition Agent <br />SUBJECT: Right -of -Way Acquisition/41st Street/ <br />Wastewood Recyclers <br />DATE: November 30, 1990 <br />------------------------------------------------------------- <br />DESCRIPTION AND CONDITIONS <br />Forty Feet (401) of additional right-of-way needs to be <br />purchased along 41st Street by Indian River County. The <br />developer is dedicating thirty feet (301) on the site plan. <br />There is an existing 30' right-of-way at this location. <br />100' feet of right-of-way is required by the Comprehensive <br />Plan. The 40' width x 132.89' frontage contains 5,316 <br />square feet at .570 per square foot and equates to a <br />purchase price of $3,030. The seller has executed the <br />attached contract for the right-of-wayto be purchased, <br />but the Attorney's office would like o prepare a better contract.. <br />RECOMMENDATIONS AND FUNDING <br />Staff request authorization to purchase the 400 x 132.89' <br />additional right-of-way at a cost not to exceed $3,030 and <br />requests the chairman of the Board of County Commissioners <br />sign the realty contract: when completed by the Attorney's <br />office. <br />Funding to be from Impact Fee Fund #101-158-541 <br />ON MOTION by Commissioner Scurlock, SECONDED by <br />Commissioner Wheeler, the Board unanimously authorized <br />the purchase of 40' x 132.89' additional right-of-way <br />at a cost not to exceed $3,030 and authorized the <br />Chairman's signature on the realty contract and <br />warranty deed when completed by the Attorney's Office, <br />as recommended by staff. <br />WARRANTY DEED IS ON FILE IN THE OFFICE OF THE CLERK TO THE BOARD <br />128 <br />
