Director Keating stressed that the proposed Resolution of <br />transmittal should not be approved until the Board has considered <br />all the 8 Comprehensive Plan amendment requests. He explained <br />that the first request concerns the remedial actions amendment to <br />approve the actions in the Compliance Agreement-; the second set <br />of 3 are amendments submitted by the intervenors; and the final 4 <br />are amendments that were submitted during the July Comp Plan <br />amendment window timeframe; and these all need to be considered <br />differently. The remedial actions amendment and the intervenors <br />are all really extensions of the Comp Plan process; so, essenti- <br />ally we are applying the same criteria as when we considered the <br />Comp Plan back in February. The last 4 are amendments to that <br />Plan that have been submitted separately, and when reviewing <br />those, we are actually looking at concurrency and general <br />policies that are in the Plan. After all these have been <br />considered, then the Board can consider the Resolution of <br />transmittal and delete or add any amendments. <br />Commissioner Wheeler noted that we drew up a plan and <br />submitted it to the DCA and they denied it; then Chairman Eggert <br />and staff negotiated and came to some kind of agreement with the <br />DCA; so, if we now go back in and make a change, are we not back <br />into negotiation with the DCA? <br />Asst. County Attorney Collins explained that the Compliance <br />Agreement provided that if we did not transmit these recommended <br />remedial actions within a certain time frame both parties reserve <br />their right to an administrative hearing. <br />Commissioner Scurlock believed Commissioner Wheeler's <br />question is why are the intervenors here before us today rather <br />than being before the DCA.
