DEC <br />IO <br />BOOK <br />P �` <br />Attorney Collins agreed that <br />ideally you would <br />like <br />the <br />people on the other side of the street to be notified, but he <br />pointed out that this won't take final effect until it comes back <br />from Tallahassee in 90 days and then you have another public <br />hearing. <br />Chairman Eggert asked Public Works Director Davis about the <br />status of 43rd Avenue from 13th south as far as our Transporta- <br />tion Plan is concerned, and Director Davis advised that we have <br />acquired some R/W but there are no plans in the next 5/10 years <br />to do a capacity expansion to 4,3rd. 43rd is designated on the <br />Thoroughfare Plan as an arterial route; however, it is <br />functioning today as a collector road. <br />Commissioner Scurlock felt what Mr. Poppell suggests has <br />some merit, but he has some difficulty dealing with the issue at <br />this time and wondered why we can't address it at one of those 6 <br />months periods when we have all the written correspondence and <br />not depend on hearsay. <br />Chairman Eggert agreed that what we don't have now is the <br />background material the DCA needs to see, and they would have <br />this if they had a formal amendment. <br />Director Keating advised that staff suggested that Mr. <br />Poppell come in with a separate Comp Plan amendment after we <br />resolve the Compliance Agreement. He believed that actually the <br />DCA would love to have the land east of 43rd 3 upa or 1 upa, but <br />he stressed that the Board has to make a finding as to what the <br />facts are that justify the suggested change. <br />Mr. Poppell continued to argue that the County has been <br />inconsistent with their densities and stressed that most of the <br />area on the east side of 43rd which is 6/1 is in the flood plain <br />also. <br />Commissioner Wheeler asked what would the DCA do if we <br />reduced the 6/1 to 3/1 in the flood plain area and put 3/1 across <br />where it would balance out as suggested earlier. and Attorney <br />Collins just could not say. <br />In terms of overallocation of <br />56 <br />
