JAN 2 091 <br />BOOK 8 <br />2P,% E 4 0 ,� <br />Utilities Director Terry Pinto felt the important part of <br />this agreement is that it puts us in the position of being able <br />to request and obtain the specific information we need to analyze <br />whether it would be a reasonable purchase. Under the existing <br />situation, the utility has to respond only to the City of <br />Sebastian, and, therefore, won't give us the information we need. <br />Commissioner Scurlock understood that approval of this item <br />does not authorize any expenditure outside for any professional <br />services beyond what the Board has approved already, and Director <br />Pinto replied affirmatively. <br />Commissioner Scurlock explained that he was getting some <br />information from some other counties that their outside fees are <br />`running very high and that much of that is not needed. St. <br />Lucie's administrator feels that they could do a lot more <br />internally rather than just contracting all of it out. <br />Director Pinto advised that in this case we already have <br />selected and hired a firm to do the engineering analysis for the <br />north county, and when we attempted to do that analysis, the <br />"itility barred us from having access to the site. This agreement <br />will allow us access. <br />MOTION WAS MADE by Commissioner Scurlock, SECONDED by <br />Commissioner Eggert, that the Board approve the <br />Assignment transferring all the City rights to the <br />County, and authorize the Chairman's signature; and <br />authorize the Utilities Department to proceed in the <br />acquisition of the GDU North County utility facilities, <br />as recommended by staff. <br />Considerable discussion ensued with regard to a question <br />raised by Mr. Steven Pitiak, resident of Park Place, Sebastian, <br />as to what type of appraisal process would be followed for the <br />acquisition. <br />Mir. Pitiak understood from the paper that one appraiser is <br />picked by the County, one by the developer, and the other by both <br />appraisers. He wished to know if this is a standard -procedure in <br />the county when acquiring these private utilities. <br />Attorney Vitunac explained that this was not written by the <br />County. This was written by the City of Sebastian many years ago <br />and is not County policy. The County is bound by this, and we <br />can get only the rights that are in this contract. <br />35 <br />
