Chairman O'Bryan asked Commissioner Wheeler if he wished to amend his Motion such <br />that the County Attorney could take whatever legal action he felt was appropriate to bring this <br />matter to a final resolution. <br />MOTION WAS AMENDED by Commissioner Wheeler, <br />SECONDED by Chairman O'Bryan, to authorize the <br />County Attorney to take whatever legal action deemed <br />appropriate to achieve a permanent resolution of the issues <br />entailed in the Fred and Rita Mensing case v. Indian River <br />County. <br />Attorney Polackwich affirmed that he would defend the case and seek a conclusion on <br />this matter. He conveyed that the Board and appropriate staff could legally have, if desired, a <br />SHADE meeting to discuss this matter in further detail. <br />The Chairman CALLED THE QUESTION, and by a 4-1 <br />vote (Commissioner Davis opposed), the Motion carried. <br />The Board authorized the County Attorney to take <br />whatever legal action deemed appropriate, to achieve a <br />permanent resolution of the issues entailed in the Fred and <br />Rita Mensing case v.
