REQUEST FOR PRIVATE ATTORNEY-CLIENT MEETING RELATING TO FVP <br />ML4MI LAKES V. INDIAN RIVER COUNTY <br />Attorney Polackwich elaborated on his request for a private Attorney -Client meeting to <br />seek the Board's input on a civil lawsuit filed by FVP Miami Lakes, LLC (successor/assignee of <br />Lennar Homes, LLC) that relates to impact fees paid in connection with the Tripson Estates and <br />Madera Isles projects. He suggested the Board schedule the meeting in conjunction with the <br />• <br />regularly scheduled Board meeting of November 15, 2011. <br />ON MOTION by Commissioner O'Bryan, SECONDED <br />by Commissioner Flescher, the Board unanimously <br />approved to schedule a private attorney-client meeting <br />relating to FVP Miami Lakes v. Indian River County, to <br />be held in connection with the regularly scheduled Board <br />meeting on November 15, 2011, as recommended in the <br />memorandum of October 12, 2011. <br />13. C. PROPOSED RESOLUTION SETTING FORTH THE BOARD'S POSITION ON THE <br />REFERENDUM QUESTION RELATING TO THE LEASING OF THE CITY'S <br />POWER PLANT SITE IN CONNECTION WITH THE POSSIBLE SALE OF THE <br />CITY ELECTRIC UTILITY <br />Attorney Polackwich provided background and description on the proposed Resolution <br />setting forth the Board's support for a "Yes ' vote on the referendum question on the November <br />October 18, 2011 38 <br />141 P6 5.9.0 <br />
