Davis, Director of Public Works^_ <br />DATE: February 5, 1991 <br />RE: POLICY ON USE OF RIGHT OF WAY FOR WATER WELLS <br />Private wells shall not be allowed in the right of way except potable <br />water wells for single-family residences where there is a demonstrated <br />unusual hardship and then only under the following conditions: <br />1. The appropriate state agency has determined that construction of <br />a potable water well on the applicant's property is not permitted <br />under state law. <br />2. There is no other practical method of obtaining potable water. <br />3. County potable water is projected to be available to the property <br />within two years. <br />4. The exact location and material specifications of any construction <br />in the right of way shall be determined by the County. <br />5. Any permitted use shall require that all portions of the well in <br />the right of way be underground to a depth of not less than two <br />feet. <br />6.
