1. It must be shown that the persons making application for <br />the vacation own fee simple title to that part of the <br />tract covered by the plat sought to be vacated. <br />2. It must be shown that the vacation will not affect the <br />ownership or right of convenient access of persons owning <br />other parts of the subdivision. <br />3. Notice of the intention to apply to the County Commission <br />for vacation of the plat must be published in a newspaper <br />of general circulation. <br />4. Proof of publication of the petition for vacation must be <br />attached to the petition. <br />5. Certificates showing that all State and County taxes have <br />been paid must be provided. <br />The applicant has submitted all of the above information which has <br />been reviewed and approved by the County Attorney's Office. Thus, <br />all state requirements concerning plat vacation have been met, and <br />staff has no objections to the requested vacation. <br />Requirements for final plat approval have been satisfied for the <br />requested Second Replat. Staff has no objections to granting final <br />plat approval for this Second Replat. <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners: <br />1. Adopt the attached resolution vacating lots 6 through 27, 32 <br />through 50, 57 through 68 and 104 through 113 (inclusive) of <br />the Cambridge Park plat as recorded in Plat Book 12, Page 98A <br />and 98B; <br />2. authorize the Chairman to sign the plat vacation resolution; <br />and <br />3. approve the submitted Cambridge Park Second Replat. <br />The Chairman opened the Public Hearing, and asked if anyone <br />wished to be heard in this matter. There being none, he closed <br />the Public Hearing. <br />ON MOTION by Commissioner Wheeler, SECONDED by <br />Commissioner Eggert, the Board unanimously approved the <br />submitted Cambridge Park Second Replat and adopted <br />Resolution 91-20, vacating lots 6 through 27,32 <br />through 50, 57 through 68 and 104 through 113 <br />(inclusive) of the Cambridge Park plat as recorded in <br />Plat Book 12, Page 98A and 98B. <br />191J' <br />199 �no� FaJE 1 <br />
