Attorney O'Haire indicated that rather than alternates to the <br />alignment, the discussion would be regarding alternates to the <br />mitigation that has been recommended for dredge and fill activities <br />because his clients own so much land and mitigation is as important <br />to the property owners in the future as it is for the County. <br />Commissioner Scurlock suggested Director Davis should address <br />the issue. <br />Director Davis believed there had been some communication <br />regarding Mr. O'Haire's clients' counteroffer to, perhaps, make <br />available some alternate mitigation site and he asked if that would <br />mean total abandonment of the original plan proposed for <br />impoundment Number Two. <br />Mr. O'Haire indicated it might be partial or total <br />abandonment. His clients have an open mind, but they don't think <br />all of the property in the original plan is needed because the <br />parcel in question is high and dry riverfront and is very valuable <br />property whereas there is 250 acres to the north that is a little <br />bit damper. <br />Director Davis felt there would be lengthy delays involved <br />with such a change, possibly a year or more, since in the <br />permitting of the project the County has gone through a laborious <br />program with Florida DER, the Army Corp of Engineers and many other <br />permitting agencies that have review status on those permits. The <br />project is very close to going to bid and a change of this <br />magnitude would certainly set the schedule for implementing the <br />Phase III section of the Boulevard into the future. It would be <br />very difficult to judge whether that would be six months or a year. <br />In addition, the County has already purchased and filed <br />condemnation on Parcel 103, which is the parcel south of the parcel <br />under discussion; and we are in the midst of entering into a <br />management plan with the Indian River Development Mosquito Control <br />District, with permits in hand that have been very difficult to <br />acquire. It would also change the design of the project. <br />Commissioner Scurlock asked whether the permits that we <br />currently have would still be valid. <br />Director Davis replied they would have to be modified. <br />Attorney O'Haire requested an opportunity to discuss the <br />timing issue. <br />Commissioner Eggert asked why Mr. O'Haire is addressing this <br />issue now, when we have been going through this for what seems like <br />seven ages. <br />Attorney O'Haire replied dialogue has been ongoing and the <br />different aims of the property owners involved have impeded <br />tremendously the resolution of the problem.
