INDEMNIFICATION AGREEMENT BETWEEN IRC UTILITIES AND WINDSOR <br />POLO CLUB M <br />The Board reviewed the following memo dated 3/1/91: <br />DATE: MARCH 1, 1991 <br />TO: JAMES E. PIN <br />DIRECTOR OF UTIII�I Y SERVICES <br />PREPARED WILLIAM MCCAIN <br />AND STAFFED CAPITALT ENGINEER <br />BY: DEPARTME TILITY SERVICES <br />SUBJECT: INDEMNIFICATION AGREEMENT BETWEEN INDIAN <br />RIVER COUNTY UTILITIES DEPARTMENT AND <br />WINDSOR POLO CLUB <br />BACKGROUND AND ANALYSIS <br />Windsor has requested to locate their entrance guardhouses <br />differently than what was originally approved by Indian River <br />County. The new location sets the buildings directly over an <br />existing sewer system. Due to this relocation, we have required <br />Windsor Properties, Inc., to enter into an Indemnification Agreement <br />with Indian River County, to hold the County harmless. (See <br />attached agreement.) <br />RECOMMENDATION <br />The staff of the Department of Utility Services recommends that the <br />Board of County Commissioners approve the attached agreement with <br />Windsor Properties, Inc. <br />MOTION WAS MADE by Commissioner Wheeler, SECONDED by <br />Commissioner Eggert, that the Board approve the <br />Indemnification Agreement between IRC Utilities and <br />Windsor Polo Club and authorize the Chairman's <br />signature, as recommended by staff. <br />Under discussion, Commissioner Bowman expressed her concern <br />over why we allowed them to build over a utility easement, and <br />Utilities Director Terry Pinto explained that this line only <br />serves the guard shack; it is not the main line for the <br />development. <br />THE CHAIRMAN CALLED FOR THE QUESTION.
