Attorney Collins summed up that this essentially would release <br />the County from any claims and liabilities to Mr. Newmark and the <br />Allens and would allow them to continue making use of this road as <br />they have in the past without being charged as a trespasser. <br />It was noted there necessarily would have to be some access <br />point from the Boulevard to get on the impoundment dike, and <br />Commissioner Scurlock noted that Public Works Director Davis has <br />worked so hard trying to limit access to the Boulevard and keep it <br />flowing freely that he did not want to jeopardize that. <br />Attorney Collins believed there has to be an access point to <br />maintain the dike in any event, and that access point just would <br />not be open to the general public. <br />Director Davis confirmed that we do have a need to get on the <br />dike surrounding the impoundment to construct and maintain the <br />culvert that is placed between the impoundment and the river, and <br />the Main Relief Canal bridge is going to contain a roadway beneath <br />the bridge. The intent is to put a roadway within the main canal <br />right of way to be a service roadway. There also probably will be <br />a graded connection from the Boulevard onto the dike itself. <br />Director Davis did not see any problem with this. <br />Mr. Newmark was present and believed Attorney Collins covered <br />everything adequately. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Scurlock, the Board unanimously <br />authorized the Chairman to execute the proposed <br />Settlement Agreements and Releases with E. M. <br />Newmark and with Edmond and Doris Allen as <br />recommended by staff. <br />SAID DOCUMENTS ARE ON FILE IN THE OFFICE OF <br />CLERK TO THE BOARD <br />MEETING IN TALLAHASSEE <br />Chairman Bird informed the Board that he had received a letter <br />from Pat Corrigan of the Cattlemen's Association, who will be <br />flying in his airplane to the meeting, and has invited any Board <br />Member or staff representative to join him. Planning Director <br />Boling also has received a letter in regard to this same meeting <br />from Ernie Padgett of Santa Rosa County. <br />Planning Director Boling brought up the difference in the <br />status of our Comprehensive Plan from those of the 26 counties <br />planning the meeting.
