Smith, Inc. <br />The Board reviewed memo from County Attorney Vitunac: <br />TO: <br />BOARD <br />OF <br />COUNTY <br />COMMISSIONERS <br />FROM: <br />Charles <br />P. <br />Vitunac, <br />County Attorney <br />DATE: March 22, 1991 <br />RE: SURETY BOND - DENNIS L. SMITH, INC. <br />The payments of the monthly Solid Waste Disposal District tipping fee <br />charges for Dennis L. Smith, Inc. were secured by a surety bond in <br />the amount of $10,000. The company recently went into Chapter 11, <br />bankruptcy, owing the District:. approximately $11,500. The Utilities <br />Department has made a timely claim against the bond, and the bonding <br />company, after some negotiation, is prepared to pay the County the <br />face amount of the bond, i.e., $10,000, if the County will sign a <br />release of its rights against the bonding company as surety for Dennis <br />L. Smith. <br />Staff recommends execution of the release so that the County can get at <br />least $10,000 of the $11,500 owed to it. The remaining money will be <br />filed as a claim in the bankruptcy. <br />ON MOTION by Commissioner Eggert, SECONDED by Com- <br />missioner Scurlock, the Board unanimously -authorized <br />the Chairman to sign the Release of rights against <br />USF&G Company as surety for Dennis L. Smith as <br />recommended by staff. <br />6 <br />
