understood and agreed by said Bidder, that if the award is cancelled for the above
<br />persons, the certified check or Bid Bond shall become the property of the Owner, not as a
<br />penalty, but as liquidated damages.
<br />1.16 PUBLIC CONSTRUCTION BOND
<br />The successful Bidder as Contractor shall furnish the County immediately upon delivery with the
<br />executed Contract and a Public Construction Bond in an amount equal to 100 percent of the
<br />contract price, each in the form provided in the Contract Documents. The Surety shall be
<br />authorized to issue surety bonds in Florida and be included in the most recent United States
<br />Department of Treasury List of Acceptable Sureties. The successful Bidder shall require the
<br />attorney-in-fact, who executed the Public Construction Bond to affix to each a current certified
<br />copy of their Power of Attorney, reflecting such person's authority as Power of Attorney in the
<br />State of Florida. Further, at the time of execution of the Contract, the successful Bidder shall
<br />provide a copy of the Surety's current valid Certificate of Authority issued by the United States
<br />Department of the Treasury under 31 United States Code sections 9304-9308.
<br />1.17 PUBLIC DISCLOSURE STATEMENT
<br />Any entity entering into a contract with Indian River County as Owner shall disclose any
<br />relationship that may exist between the contracting entity and an Indian River County
<br />Commissioner or Indian River County employee. The relationship with either must be'disclosed
<br />as follows: Father, mother, son daughter, brother, sister, uncle, aunt, first cousin, nephew, niece,
<br />husband, wife, father-in-law, mother-in-law, daughter-in-law, son-in-law, brother-in-law, sister-
<br />in-law, stepfather, stepmother, stepson, stepdaughter, stepbrother, half brother, half sister,
<br />grandparent, or grandchild. The term "affiliate" includes those officers, directors, executives,
<br />partners, shareholders, employees, members, and agents who are active in the management of the
<br />entity.
<br />1.18 FLORIDA PRODUCED LUMBER
<br />The selected Bidder agrees to comply with the provisions of Section 255.20, Florida Statutes, as
<br />such statute may be amended from time to time, wherein Indian River County as Owner must
<br />specify lumber, timber and other forest products produced and manufactured in Florida whenever
<br />such products are available and their price, fitness and quality are equal.
<br />1.19 TRENCH SAFETY
<br />Florida Statutes Section 553.60 through 553.64, known as the "Trench Safety Act" requires all
<br />contractors engaged by Indian River County, Florida to comply with Occupational Safety and
<br />Health Administration's excavation safety standard, found in 29 C.F.R. s. 1926.650 Subpart P. All
<br />prospective subcontractors are required to sign a Trench Safety Act Compliance Statement and
<br />provide compliance cost information where indicated. The costs for complying with the Trench
<br />Safety Act must be incorporated into the Bid.
<br />1.20 PUBLIC ENTITY CRIME STATEMENT
<br />Pursuant to Florida Statutes Section 287.133(2)(a), all Bidders are hereby notified that a person
<br />or affiliate who has been placed on the convicted vendor list following a conviction for a public
<br />entity crime may not submit a bid, proposal, or reply on a contract to provide any goods or
