that Oyster Bay, who took a very strong position that they have <br />their own system and shouldn't be forced to connect to our <br />system, were found out to be by-passing their waste directly to <br />the river. Now the DER is after them, and they are saying please <br />let us connect, and they are right in the middle of Sebastian. <br />ON MOTION by Commissioner Scurlock, SECONDED by Com- <br />missioner Eggert, the Board unanimously directed the <br />Chairman with the assistance of Administrator Chandler <br />and Utilities Director Pinto, to write a letter to <br />the City Council of Sebastian advising that we intend to <br />remove them and go on our way unless instructed otherwise <br />and that we need an answer by such and such a date. <br />AGREEMENT TO FACILITATE CONSTRUCTION OF COURTHOUSE & PARKING <br />FACILITIES <br />The Board reviewed memo from Asst. County Attorney O'Brien: <br />TO: Board of County Commissioners <br />FROM: Terrence P. O'Brien - Assistant County Attorne v <br />DATE: May 8, 1991 <br />RE: AGREEMENT TO FACILITATE THE CONSTRUCTION OF THE <br />NEW COURTHOUSE AND ASSOCIATED PARKING FACILITIES <br />The attached agreement which is self-explanatory would, if executed by <br />all parties, allow for the continued operation of the Florida Federal <br />drive-in facility. Because of time constraints this agreement is being <br />circulated to all parties at the same time. It is anticipated that the <br />City of Vero Beach will consider it at its May 21, 1991 meeting. <br />ON MOTION by Commissioner Scurlock, SECONDED by Com- <br />missioner Wheeler, the Board unanimously approved <br />Agreement w/the City of Vero Beach; Vero Limited <br />Partnership; Florida Federal Savings & Loan Assoc.; <br />and the Downtown Merchants Assoc. <br />COPY OF PARTIALLY SIGNED AGREEMENT IS ON FILE IN THE OFFICE OF <br />CLERK TO THE BOARD. <br />tij <br />MAY 14 1991 61 <br />J <br />
