ACCEPTANCE/REJECTION <br /> The County reserves the right to accept or to reject any or all bids and make the award to the bidder, <br /> who in the opinion of the County will be in the best interest of and/or the most advantageous to the <br /> County. The County also reserves the right to reject the bid of any vendor who has previously failed <br /> in the proper performance of an award or to deliver on time contracts of a similar nature or who is <br /> not in a position to perform properly under this award. The County reserves the right to inspect all <br /> facilities of bidders in order to make a determination as to the foregoing. The County reserves the <br /> right to waive any irregularities and technicalities and may, at its discretion, request a re-bid. <br /> 16. SELECTION OF BIDDER WITH WHOM TO CONTRACT <br /> Selection will be based on the lowest responsible and responsive bidder. The ability to meet the <br /> County's construction schedule requirements will be a factor in determining responsiveness, along <br /> with the ability to meet all other requirements in the Invitation to Bid. The County reserves the right <br /> to determine whether the based bid construction schedule or the alternate construction schedule <br /> best fit the County's needs and budget. <br /> 17. PROTEST PROCEDURE <br /> Protest procedures are provided in Section 8.1.13 of the County Purchasing Manual. Any actual <br /> or prospective Bidder who is aggrieved in connection with the solicitation or proposed award of a <br /> contract may protest to the Purchasing Manager. The protest shall be submitted in writing within <br /> seven (7) calendar days after such aggrieved person knows or should have known the facts rise <br /> thereto. If the protest is not resolved by mutual agreement, the Purchasing Manager shall <br /> promptly issue a decision in writing, after consulting the Department and the Office of the County <br /> Attorney. <br /> 18. WARRANTIES <br /> The Contractor shall be required to provide a written one (1) year warranty covering all labor, <br /> equipment, and materials provided. If required, as specified elsewhere in these documents, the <br /> Contractor shall furnish to the County a Public Construction Bond in the amount of 100% of the <br /> contract value at time of signing contract. <br /> 52 <br />
