DEP AGREEMENT NO. G0353 <br /> AMENDMENT NO. 1 <br /> THIS AGREEMENT as entered into on the 8h day of January, 2013 between the STATE OF FLORIDA <br /> DEPARTMENT OF ENVIRONMENTAL PROTECTION (hereinafter referred to as the "Department") and <br /> INDIAN RIVER COUNTY (hereinafter referred to as the"Grantee")is hereby amended. <br /> WHEREAS,the Grantee was awarded funding under the State Total Maximum Daily Load(TMDL)Grant <br /> Program to offset project costs;and, <br /> WHEREAS, the Grantee has requested, and the Department has agreed, to amend the Agreement to revise <br /> the Grant Work Plan;and, <br /> WHEREAS,other changes to the Agreement are necessary. <br /> NOW,THEREFORE,the parties hereto agree as follows: <br /> 1. Paragraph 3A and 31 are hereby deleted and replaced with the following: <br /> A. As consideration for the satisfactory completion of services rendered by the Grantee under the <br /> terms of this Agreement, the Department shall pay the Grantee on a cost reimbursement basis up <br /> to a maximum of$2,226,900.00 (an increase of$1,376,900.00) towards the total estimated cost <br /> for the PC South Algal Nutrient Removal Facility Project of$9,551,568.40. The parties hereto <br /> understand and agree that the funding under this Agreement is comprised of EPA Section 319 <br /> (319) funding in the amount of $850,000.00 and State TMDL funding in the amount of <br /> $1,376,900.00. <br /> i. The parties hereto understand and agree that the 319 funding under this Agreement <br /> requires a 63%match($1,440,853.40). <br /> ii. TMDL funding under this Agreement requires a 75% match on the part of the Grantee. <br /> Therefore, the Grantee is responsible for providing $4,049,947.00 through cash or third <br /> party in-kind,towards the work funded under this Agreement. <br /> iii. All match shall meet the federal requirements established in 40 CFR Part 30,40 CFR Part <br /> 31 and OMB Circulars A-87(2 CFR 225),A-122(2 CFR 230)and A-21 (2 CFR 220),as <br /> applicable. <br /> iv. It is understood that any additional funds necessary for the completion of this project is <br /> the responsibility of the Grantee.
