Van Fleet Water Production Facility Improvements BVP 13-196 <br /> Conditions. Except for said reliance on such "technical data,"the Contractor may not rely upon or make <br /> any claim against the County, Professional or any of the Professional's consultants with respect to: <br /> 5.3.1.1 the completeness of these reports and drawings for the Contractor's purposes, <br /> including, but not limited to, any aspects of the means, methods,techniques, sequences and procedures of <br /> construction to be employed by the Contractor and safety precautions and programs incident thereto; or <br /> 5.3.1.2 other data, interpretations, opinions and information contained in said reports or <br /> shown or indicated in said drawings; or <br /> 5.3.1.3 an Contractor interpretation <br /> " <br /> y of or conclusion drawn from any technical data or <br /> any such data, interpretations, opinions or information. <br /> 5.4 Unknown or Concealed Conditions <br /> 5.4.1 If conditions are encountered, excluding existing utilities, at the site which are (1) subsurface or <br /> otherwise concealed physical conditions which differ materially from those indicated in the Contract <br /> Documents or(2) unknown physical conditions of an unusual nature, which differ materially from those <br /> ordinarily found to exist and generally recognized as inherent in construction activities of the character <br /> provided for in the Contract Documents, then the Contractor shall give the County notice, through the <br /> Professional, immediately before conditions are disturbed and in no event no later than 24 hours after <br /> first observance of the conditions. <br /> 5.4.2 The Project Manager and the Professional shall promptly investigate such conditions and, if they <br /> differ materially and cause an increase or decrease in the Contractor's cost of, or time required for, <br /> performance of any part of the Work, the Project Manager and the Professional shall recommend an <br /> equitable adjustment in the Contract Price or Contract Time, or both. If the Project Manager and the <br /> Professional determine that the conditions at the site are not materially different from those indicated in <br /> the Contract Documents or are not materially different from those ordinarily found and that no change in <br /> the terms of the Contract is justified, the Professional shall notify the Contractor of the determination in <br /> writing. The Work shall be performed after the Professional provides direction. <br /> 5.5 Physical Conditions—Underground Facilities <br /> 5.5.1 The information and data shown or indicated in the Contract Documents with respect to existing <br /> Underground Facilities at or contiguous to the site is based on information and data furnished to the <br /> County or the Professional by the owners of such Underground Facilities or by others. Unless it is <br /> otherwise expressly provided in the Supplementary Conditions: <br /> 5.5.1.1 The County and the Professional shall not be responsible for the accuracy or <br /> completeness of any such information or data; and <br /> 5.5.1.2 The cost of the following will be included in the Contract Price and the Contractor <br /> shall have full responsibility for(i) reviewing and checking all such information and data; (ii) locating all <br /> Underground Facilities shown or indicated in the Contract Documents; (iii) coordination of the Work <br /> with the owners of such Underground Facilities during construction; and (iv)the safety and protection of <br /> all such Underground Facilities as provided in 7.11 and repairing any damage resulting from the Work. <br /> 5.5.2 If an Underground Facility is uncovered or revealed at or continuant to the site which was not <br /> shown or indicated in the Contract Documents, the Contractor shall, promptly after becoming aware of <br /> and before further disturbing conditions affected by or performing any Work in connection therewith <br /> 63 <br /> 112.63 <br />
