Van Fleet Water Production Facility Improvements BVP 13-196 <br /> 12.2.1.1 Labor (payroll, taxes, fringe benefits, worker's compensation, health and retirement <br /> benefits, sick leave) <br /> 12.2.1.2 Owned Equipment(at lowest applicable equipment manual rate)(Blue Book Value) <br /> 12.2.1.3 Rented Equipment(at actual rental rate) <br /> 12.2.1.4 Material <br /> 12.2.1.5 Supplies <br /> 12.2.1.6 Subcontractors' Costs <br /> 12.2.1.7 Bonds and Insurance <br /> 12.2.1.8 Contractor's Fee(per 12.3) <br /> 12.2.1.9 Permit Fees <br /> 12.2.2 The Contractor shall require all subcontractors and suppliers to comply with all requirements of, <br /> and provide itemizations of, all claims in accordance with this Article. <br /> 12.2.3 The term "Cost of the Work" shall not include any of the following: <br /> 12.2.3.1 Payroll costs and other compensation of the Contractor's officers, executives, <br /> principals (of partnership and sole proprietorships), general managers, engineers, architects, estimators, <br /> layers, auditors, accountants, procurement and contracting agents, expediters, timekeepers, clerks and <br /> other personnel employed by the Contractor, whether at the site or in its principal or a branch office, for <br /> general administration of the Change Order work and not specifically included in the agreed upon <br /> schedule of job classifications, all of which are to be considered administrative costs covered by the <br /> Contractor's mark-up. <br /> 12.2.3.2 Extraordinary fringe benefits not specifically identified in Article 12.2.1.1. <br /> 12.2.3.3 Expenses of Contractor's principal and branch offices other than the Contractor's <br /> office at the site. <br /> 12.2.3.4 Any part of the Contractor's capital expenses, including interest on the Contractor's <br /> capital used for the Change Order work and charges against the Contractor for delinquent payments. <br /> 12.2.3.5 Cost of premiums for all bonds and insurance, whether or not the Contractor is <br /> required by the Contract Documents to purchase and maintain the same (except for additional bonds and <br /> insurance required because of changes in the work). <br /> 12.2.3.6 Costs due to the negligence of the Contractor, any subcontractor or anyone directly or <br /> indirectly employed by any of them or for whose acts any of them may be liable, including but not <br /> limited to: the correction of defective Work; disposal of material or equipment wrongly supplied; and <br /> making good any damage to property. <br /> 12.2.3.7 Overhead or general expense costs of any kind (other than as provided in 12.3). <br /> 12.3 Contractor's Mark-Up <br /> 12.3.1 The maximum percentage allowed for the Contractor's combined overhead andrp ofit shall be as <br /> follows: <br /> 12.3.1.1 For all such Change Order work or Allowance Work done, a fixed percentage of the <br /> total adjustment to the Contract Price shall be negotiated and shall not exceed ten percent(10%). <br /> 79 <br />
