Van Fleet Water Production Facility Improvements BVP 13-196 <br /> 15.7 Acceptance of Defective Work <br /> 15.7.1 If, instead of requiring correction or removal and replacement of defective work, the County <br /> prefers to accept it, the County may do so. In such case, if acceptance occurs prior to approval of final <br /> payment, a Change Order incorporating the necessary revisions in the Contract Documents, including an <br /> appropriate reduction in the Contract Price, shall be issued. If the acceptance occurs after approval of <br /> final payment, the Contractor shall pay to the County an appropriate sum to compensate for the defect in <br /> the work. <br /> 15.8 Neglected Work by Contractor <br /> 15.8.1 If the Contractor neglects to execute the Work in accordance with the Contract Documents, <br /> including any requirements of the progress schedule,the Professional may direct the Contractor to submit <br /> a recovery plan and take specific corrective actions including, but not limited to, employing additional <br /> workmen and/or equipment, working extended hours and additional days, all at no cost to the County, in <br /> order to put the Work back on schedule. If the Contractor fails to correct the deficiency or take <br /> appropriate corrective action,the County may terminate the contract or Contractor's right to proceed with <br /> that portion of work and have the work done by others. The cost of completion under such procedure <br /> shall be charged against the Contractor. A Change Order shall be issued incorporating the necessary <br /> revisions in the Contract Documents, including an appropriate reduction in the Contract Price. If the <br /> payments due the Contractor are not sufficient to cover such amount, the Contractor shall pay the <br /> difference to the County. <br /> 15.8.2 Should the Contractor work overtime, weekends or holidays to regain the schedule, all costs to <br /> the County of associated inspection, construction management and resident engineering shall be <br /> identified to the Contractor and the Contract Price reduced by a like amount via Change Order. <br /> ARTICLE 16—PAYMENT AND COMPLETION <br /> 16.1 Schedule of Values <br /> 16.1.1 The Schedule of Values established as provided in 3.5.5 will serve as the basis for progress <br /> payments and will be incorporated into a form of Application for Payment acceptable to the Professional <br /> and the Project Manager. Progress payments using unit prices will be based on the number of units <br /> completed. Lump sums do not have a provision for a unit price adjustment. <br /> 16.1.2 The Schedule of Values will include a breakdown of divisions of the work in a manner that will <br /> identify subcontractors by the classification of their work according to any accepted numerical sequence, <br /> such as AIA numerical classification. Any subcontractor identified by the Contractor, as a <br /> Woman/Minority Business Entity shall be noted in the schedule of values on a separate line of the <br /> schedule of values with an extension to the numerical classification used to identify the particular <br /> division of work. The extension will be according to the following: 002- Woman Business Enterprise; <br /> 003 — African American Enterprise; 004—Hispanic American; 005 —Asian Pacific American Business; <br /> 006—Native American Business; and 007—Asian-Indian American Business. <br /> 16.2 Application for Progress Payment <br /> 16.2.1 At least seven (7) calendar days before the date established for each progress payment (but not <br /> more often than once a month), Contractor shall submit to the Professional for review an Application for <br /> Payment filled out and signed by the Contractor covering the work completed as of the date of the <br /> Application and accompanied by such supporting documentation as is required by the Contract <br /> 83 <br /> 1� a - 53 <br />
