Van Fleet Water Production Facility Improvements BVP 13-196 <br /> Contractor's Application for Payment at two times the amount of each incomplete item. Should the <br /> Contractor fail to complete the items by the date noted on the Certificate of Substantial Completion, the <br /> County may complete the item and deduct the costs from the final Application for Payment. Warranties <br /> required by the Contract Document shall commence on the date of Substantial Completion of the Work <br /> or designated portion thereof unless otherwise provided in the Certificate of Substantial Completion. The <br /> Certificate of Substantial Completion shall be submitted to the Contractor for their written acceptance <br /> and then to the County for acceptance and issuance. <br /> 16.5. 3 The County shall have the right to exclude the Contractor from the Work after the date of <br /> Substantial Completion, but the County shall allow the Contractor reasonable access to complete or <br /> correct items on the list. <br /> 16.6 Beneficial Occupancy <br /> 16.6.1 Use by the County at the County's option of any substantially completed part of the Work which <br /> (i) has specifically been identified in the Contract Documents, or (ii) the County, Professional and <br /> Contractor agree constitutes a separately functioning and usable part of the Work that can be used by the <br /> County for its intended purpose without significant interference with the Contractor's performance of the <br /> remainder of the Work, may be accomplished prior to Substantial Completion of all the Work subject to <br /> 16.5 <br /> 16.6.2 The County at any time may request the Contractor in writing to permit the County to use any <br /> such part of the Work which the County believes to be ready for its intended use and substantially <br /> complete. If the Contractor agrees that such part of the Work is substantially complete, the Contractor <br /> will certify to the County and the Professional in writing that the Contractor considers any such part of <br /> the Work ready for its intended use and substantially complete and request the Professional to issue a <br /> certificate of Substantial Completion for that part of the Work. Within a reasonable time after either such <br /> request, the County, Contractor and Professional shall make an inspection of that part of the Work to <br /> determine its status of completion. If the Professional does not consider that part of the Work to be <br /> substantially complete, the Professional will notify the County and the Contractor in writing giving the <br /> reasons therefore. If the Professional considers that part of the Work to be substantially complete, the <br /> provisions of 16.6 will apply with respect to certification of Substantial Completion of that part of the <br /> Work and the division of responsibility in respect thereof and access thereto. <br /> 16.6.3 The County, may at its discretion, reduce the amount of retainage beyond the amount prescribed <br /> in F.S. 218.735 subject to Beneficial Occupancy. <br /> 16.6.4 Retainage will not be released in the face of a claim by the County for liquidated damages or a <br /> dispute claim by the Contractor for additional compensation. <br /> 16.7 Final Inspection <br /> 16.7.1 Upon written notice from the Contractor that the entire Work or an agreed portion thereof is <br /> complete, the Professional will make a final inspection with the County and the Contractor and will <br /> notify the Contractor in writing of all particulars in which this inspection reveals that the Work is <br /> incomplete or defective. The Contractor shall immediately take such measures as necessary to complete <br /> such Work or remedy such deficiencies. <br /> 16.8 Final Application for Payment <br /> 86 <br /> L ;L <br />
