RESOLUTION NO. 2013- <br /> A RESOLUTION OF THE BOARD OF COUNTY <br /> COMMISSIONERS OF INDIAN RIVER COUNTY, <br /> FLORIDA, ACTING IN ITS CAPACITY AS THE <br /> GOVERNING BODY OF THE INDIAN RIVER COUNTY <br /> EMERGENCY SERVICES DISTRICT, REQUESTING <br /> THAT THE CITY OF FELLSMERE DISCONTINUE ALL <br /> FURTHER ACTIVITIES OF THE FELLSMERE FIRE <br /> MARSHAL'S OFFICE, WHICH ACTIVITIES ARE <br /> DETERMINED TO BE CONTRARY TO THE PURPOSE <br /> AND POWERS OF THE CONSOLIDATED EMERGENCY <br /> SERVICES DISTRICT <br /> WHEREAS, in 1990, the Board of County Commissioners, in collaboration with the <br /> governing bodies of all municipalities in the county except Indian River Shores, began the <br /> process of abolishing the then-existing North, West and South Indian River County Fire <br /> Districts, and consolidating emergency services, including fire protection and prevention <br /> services, into a single, unified and consolidated district to be known as the Indian River County <br /> Emergency Services District (the "IRC Emergency Services District" or "District"); and <br /> WHEREAS, on November 27, 1990, the Board of County Commissioners enacted IRC <br /> Ordinance 90-25, abolishing the three existing districts and establishing the consolidated IRC <br /> Emergency Services District, as a dependent special district of the Board of County <br /> Commissioners, provided that a majority of the voters of the District approved such actions at a <br /> referendum to be held on March 12, 1991; and <br /> WHEREAS, on December 4, 1990, the City Council of the City of Fellsmere adopted <br /> Resolution 90-Q, approving IRC Ordinance 90-25 and agreeing to become part of the <br /> consolidated IRC Emergency Services District, subject to the results of the March 12, 1991 <br /> referendum; and <br /> WHEREAS, on March 12, 1991, 82.35% of the voters of the District approved the <br /> abolishment of the three existing districts and the establishment of the consolidated IRC <br /> Emergency Services District —thus, completing the process of establishing a single, unified and <br /> consolidated District; and <br /> WHEREAS, pursuant to IRC Ordinance 90-251, and pursuant to the underlying statutory <br /> authority for such ordinance — namely, section 125.01(5), Florida Statutes - the sole governing <br /> body of the consolidated IRC Emergency Services District is the Board of County <br /> Commissioners; and <br /> Ordinance 90-25 was later codified in chapter 208 of the Code of Indian River County. <br /> Page 1 of 3 <br /> 158 <br />
