FIRST AMENDMENT AND MODIFICATION <br />OF <br />LEASE AGREEMENT <br />THIS FIRST AMENDMENT AND MODIFICATION OF AGREEMENT made and <br />entered into by and between INDIAN RIVER COUNTY, FLORIDA, a political <br />subdivision of the State of Florida, by and through its Board of County Commissioners, <br />whose address is 1801 27th Street, Vero Beach, Florida hereinafter referred to as <br />Lessor, and INDIAN RIVER SPORTS COMPLEX, INC., a Florida non-profit corporation <br />hereinafter referred to as Lessee: <br />WITNESSETH: <br />WHEREAS, on August 20, 2013, the Lessor did execute a Ten Year L ase with <br />the Lessee covering certain lands commonly known as the 16th Street B;II Fields, <br />located at the intersection of 16th Street and 17th Avenue, Vero Beach, Florida <br />(hereinafter the Property) an aerial photo is attached as Exhibit "A"; and <br />WHEREAS, the 11.76 acre Property consists of three s ftball/little <br />league/baseball diamonds with lights, fencing, parking, concession, press boxes and <br />announcers booths; and <br />WHEREAS, there exists a 0.52 acre parcel of vacant property (Additional Parcel) <br />owned by the Lessor abutting the Property to the north along the Property's border with <br />St. Francis Manor as depicted in the aerial photo attached as Exhibit "B"; and <br />WHEREAS, Lessee desires to add the 0.52 acre Additional Parcel to its Leased <br />Premises; and <br />WHEREAS, the Lessor has no use for the Additional Parcel and does �not see a <br />future use for the Additional Parcel; and <br />WHEREAS, the execution of the First Amendment and Modification Ihas been <br />duly authorized by the Lessor and accepted by the Lessee; <br />NOW, THEREFORE, upon the good and valuable consideration set forth in said <br />original Lease, the Lease is hereby Amended and Modified as followed: <br />A. That the real property depicted and described in Exhibit "B" attahed and <br />incorporated by reference herein, shall be added to the lease and beco a part of <br />the Property, together with all improvements thereon. The property de�cribed in <br />Exhibit "B" shall be subject to the terms of the ten year lease. <br />B. The Lessee shall be responsible for all maintenance of the Additional Parcel. <br />C. The Lessee shall cause the Additional Parcel to be covered under it' existing <br />policy of insurance and the County shall be named as an additional insured. <br />1 <br />130 <br />
