Baird, County Administrator <br />.�j <br />FROM: Stan Boling, AICP <br />Planning Director <br />DATE: November 25, 2013 <br />SUBJECT: Consideration of Amendment to Land Development Regulations (: <br />915.20(8) to Allow Drive-through and Drive -up Facilities in M <br />(Planned Developments) [LDRA-13-12-01 / 2013090051-71480] <br />N <br />3) Section <br />Use PDs <br />It is requested that the following information be given formal consideration by the Board of County <br />Commissioners at its regular meeting of December 10, 2013. <br />BACKGROUND <br />In 2012, the County adopted regulations for mixed use PD (planned development) projects, allowing <br />projects with a mix of residential and commercial uses on certain residentially designated properties, <br />,,,,,,w subject to various criteria. Those regulations implemented Future Land Use Policy 5.6 which was <br />adopted in 2010 and provides for mixed use PDs. In 2013, the county modified the mixed use <br />regulations to allow a limited amount of up -front commercial development within ixed use <br />projects. <br />Prior to the 2013 change, no mixed use projects had been proposed. Since the 2013 change, two <br />mixed use projects have been proposed at the pre -application level, and staff anticipates that a <br />formal application will soon be filed for each of those two projects. For one of those mixed use <br />projects, the developer desires to incorporate a restaurant with a drive-through or drive -up facility as <br />part of the project. Under current regulations, restaurants are allowed in mixed use PDs, ut drive- <br />through or drive -up restaurants are not allowed. <br />On behalf of the referenced mixed use project developer, Attorney Bruce Barkett has cojordinated <br />with staff and filed an LDR amendment to allow restaurants with drive-through or drive-u� facilities <br />within mixed use PDs, subject to certain criteria. <br />• PZC Hearing <br />At its meeting of November 14, 2013, the Planning & Zoning Commission (PZC) <br />recommend that the Board of County Commissioners adopt the proposed ame <br />attachment #3). <br />F:ACommunity Deve1opment\CurDevABCC\2013 BCC\915drive-thrusandups. doc <br />5-0 to <br />t (see <br />135 <br />
