Mehta, P.E., Managing Director,Solid Waste Disposal District <br /> Subject: Seventh Amendment to SWDD Feedstock Supply Agreement with INPB <br /> DESCRIPTIONS AND CONDITIONS: <br /> On July 15, 2011, the Solid Waste Disposal District (SWDD) approved the Feedstock Supply <br /> Agreement (FSA) to INEOS New Planet BioEnergy, LLC (INPB), which was subsequently amended <br /> several times with the latest being the Sixth Amendment to the FSA approved by SWDD on August <br /> 20, 2013 which provided an extension of the temporary license to occupy and use the SWDD's <br /> Vegetative Waste Management Area for storage of various stages of vegetative materials and <br /> wood chips through December 31, 2013. <br /> On December 2, 2013, INPB requested via email an extension of the temporary license through <br /> March 31, 2014. INPB no longer needs the area for storage; however,they do need additional time to <br /> remove the materials on the site. INPB is an important partner to SWDD and Indian River County as <br /> this is the first commercial-scale production in the world using INEOS Bio's breakthrough gasification <br /> and fermentation technology for conversion of biomass waste into bioethanol and renewable power. <br /> ANALYSIS: <br /> Based on mutual agreement of both parties, staff recommends approval of an extension to INPB <br /> to continue to utilize our facility for storage purposes only. The attached amendment provides an <br /> extension of the license through March 31, 2014. <br /> RECOMMENDATION: <br /> Staff recommends the SWDD Board approve and authorize the Chairman to sign the Seventh <br /> Amendment to the Feedstock Supply Agreement. <br /> ATTACHMENT(s): <br /> 1.
