Mehta, P.E. <br /> Managing Director <br /> Indian River County <br /> Solid Waste Disposal District <br /> 132574 th Avenue SW <br /> Vero Beach, Florida 32968 <br /> Subject: Work Order No. 5—Wetland Filling <br /> Final Invoice <br /> Dear Mr. Mehta: <br /> CDM Smith Inc. has completed the filling of the wetland that straddles the property line shared by the <br /> Now Indian River County Solid Waste Disposal District(SWDD) and the neighboring INEOS New Planet <br /> BioEnergy Facility(INP BioEnergy).When initially authorized by the Board of County Commissioners, it <br /> was anticipated that the wetland filling would be completed within 30 days of the Notice to Proceed; <br /> however,that schedule was accompanied by a statement that, "Schedule is highly dependent on <br /> weather conditions and scheduling of associated INP BioEnergy project(as both will be performed by <br /> the same contractor)."The intent was that the INP BioEnergy contract milestones would take precedent <br /> in terms of scheduling the work. <br /> During the course of the past year, both the dry and wet seasons have been exceptionally rainy,which <br /> caused several months delay in being able to demuck the wetland,dry the material,transport the <br /> material, and most importantly, properly fill the resulting hole.To properly fill the wetland,the work <br /> had to be done in lifts(placement of dirt layers a few feet thick followed by compaction prior to placing <br /> the next layer).The continual rains had a significant impact on the contractor's ability to adequately dry <br /> and compact one layer before moving on to the next.This led to the majority of the delays in completing <br /> this work.Additional "delays" in completing the wetland work were attributable to changes in the <br /> project schedule for the INP BioEnergy project,which required the contractor's attention.The intent <br /> was for the contractor to primarily be able to meet those INP BioEnergy contractual requirements,and <br /> complete the SWDD wetland filling portion as efficiently as possible once the INP BioEnergy <br /> requirements were met. <br /> All dried muck removed from the wetland has now been transported to the designated location on the <br /> SWDD property for storage and future use of the material for cover.
