An attorney for the bank did attend the August, 2012 hearing board, and despite <br /> the arguments, the board did enter civil penalty of two thousand dollars <br /> ($2,000.00), with an additional five thousand dollar ($5,000.00) suspended <br /> penalty due if the Respondent did not come into compliance. As of the date of <br /> the hearing, the property had been significantly cleaned up by the bank, and the <br /> $2,000 fine was paid in September, 2012. The department also received notice <br /> that the property was demolished and agrees that the Respondent is in <br /> compliance. Case No. 500-12 <br /> 4. The Respondents, Nathan and Laura Foster, entered into a written OSTDS <br /> Permit Payment Plan Agreement with the Health Department in regard to permits <br /> pulled regarding work to be performed by them upon real property located at <br /> 3355 6T" St. Vero Beach, FL 32967, with regard to a site evaluation, a permit <br /> application, and an initial inspection fee. <br /> The Health Department agreed to allow Respondent to enter into a payment plan <br /> for the evaluation, permit application and initial inspection fees to be repaid to the <br /> Health Department totaling $245.00, which initially was not paid until the <br /> Respondents, Nathan and Laura Foster, were served with Hearing Board <br /> paperwork. Case No. 502-12 <br /> 5. The Respondent, O & N Investments, Inc. with a fictitious business name of <br /> "Country Trailer Park" satisfied the lien of four thousand five hundred dollars <br /> ($4,500.00) Case 485-11. <br /> 6. The Environmental Health Staff have continued to work with the County <br /> Attorney's office regarding revisions to the Grease Trap Ordinance. The matter is <br /> undergoing final review at the present time and should be finalized and able to be <br /> brought before the Board of County Commissioners before the end of the next <br /> fiscal year. <br /> 7. Lamb's Enterprises, Inc. owned and operated by Gladys B. Lamb. A civil penalty <br /> of one thousand eight hundred dollars ($1,800.00) was levied for the violations <br /> and Respondent entered into a six (6) month payment plan. The Respondent has <br /> corrected violations and is in compliance with the order and paid the civil penalty <br /> in full. Case No. 494-11. (Civil Penalty $1,800 Paid in Full) <br /> 8. Environmental Health staff continued archiving case files and completed work on <br /> a case and fine tracking system. <br /> 9.
