Polackvich, Sr. —County Attom:22y� <br /> DATE: February 13, 2013 <br /> SUBJECT: Resolution Delegating to the County Administrator or Designee the <br /> Authority to Execute Standard Cash Deposit and Escrow Agreements <br /> Relating to Chapter 934, Excavation and Mining, of the Code of Indian <br /> IVAN- River County <br /> When approved projects are required under Chapter 934, Excavation and Mining, of the Code <br /> to post security to guaranty one or more of compliance, restoration and road maintenance, and <br /> the security is in the form of cash rather than letters of credit or surety bonds, a standard Cash <br /> Deposit and Escrow Agreement must be entered into. <br /> The standard Cash Deposit and Escrow Agreement requires the approval of the Board of <br /> County Commissioners and the signature of the Chairman through the scheduling of the <br /> matter on an upcoming agenda, thus holding up the developer's project. Because this process <br /> is administrative in nature, presented herewith for consideration is a Resolution authorizing <br /> the County Administrator or his designee to execute standard Cash Deposit and Escrow <br /> Agreements so long as the document bears approval signatures of the County Attorney or <br /> designee, and the Budget Director or designee. Section 101.05.1.q of the Code also allows <br /> the Board to authorize the County Administrator or his designee to perform other duties on <br /> behalf of the Board. <br /> REQUESTED ACTION: <br /> Adopt the attached Resolution delegating to the County Administrator or designee the <br /> authority to execute standard Cash Deposit and Escrow Agreements so long as the document <br /> 4RICVED FOR =-�-- <br /> 3 <br /> Q.C.C.
