Potential Impact on Environmental Qualit <br />As previously stated, the Florida Game and Fresh Water Fish <br />Commission (GFC) has identified the subject property as part of a <br />larger sand pine scrub habitat. The property is less than 10% <br />disturbed, and at least two rare endemic species have been <br />identified on-site; these are the gopher tortoise and the Florida <br />scrub lizard. As such, the applicant will be required to <br />coordinate with the GFC and the U.S. Fish and Wildlife Service to <br />protect such species to the extent feasible. <br />Since the subject property has been determined to be a part of the <br />county's environmentally important upland area, the applicant must <br />comply with the specific land development regulation requirements <br />in Chapter 829, Upland Habitat Protection. These regulations will <br />be applied at the time of development review, and include the <br />requirement of an upland habitat 10-15 percent set-aside. <br />The subject property I's also located within the Surficial Aquifer <br />Primary Recharge Overlay District, (SAFROD). Specific requirements <br />in Chapter 931, Wellfield and Aquifer Protection, of the county's <br />Land Development Regulations limit certain uses in the SAFROD <br />district and mandate that development in that district be j <br />,-coordinated with the environmental health department at the time of <br />development review for the protection of groundwater quality and <br />quantity. <br />As indicated, the subject property has a number of environmentally <br />sensitive characteristics. These, however, do not preclude <br />development of the subject property. Given the county's adopted <br />environmental protection regulations, the property could be <br />developed as either residential or commercial without significant <br />adverse impacts. <br />Consistency with the Comprehensive Plan <br />Land use amendment requests are reviewed for consistency with all-' <br />policies of the comprehensive plan. As per section 800.07(1) of <br />the County Code, the "Comprehensive Plan may only be amended in <br />such a way as to preserve the internal consistency, of the plan <br />pursuant to Section 163.3177(2)F.S." Amendments must also show <br />consistency with the overall designation of land uses as depicted <br />on 't Future Land Use Map, which includes agricultural, <br />..residential, recreational, conservation, and commercial and <br />industrial land uses and their densities. Commercial and <br />industrial land uses are located in nodes throughout the <br />unincorporated areas of Indian River County. <br />The goals, objectives and policies are the most important parts of <br />the Comprehensive Plan. Policies are the actions which the county <br />will take in order to direct the community's development. <br />Specifically, policies are the courses of action or ways in which <br />=programs and activities are conducted to achieve an identified goal <br />or objective. While all comprehensive plan policies are important, <br />some have more applicability than others- in reviewing plan <br />amendment. requests. _ <br />i; -Future Land Use Policy 13.3: <br />In evaluating a land use amendment request, -the most important <br />consideration is Future Land Use Element Policy 13.3.. This policy <br />requires that one of.three criteria be met in order to approve a <br />land use amendment request. These criteria are: <br />* a mistake in the approved comprehensive plan <br />* an oversight in the approved comprehensive plan, or <br />* a substantial change in circumstances affecting the <br />subject property <br />Based upon staff determination, this land use amendment does not <br />meet any of the three criteria as stated above. <br />23 <br />_Y O <br />
