Mr. Mayfield felt <br />the buffering between the single-family residential area to the <br />west consisting of two hundred feet of multifamily residential was <br />sufficient to meet the 10% to 15% required by the ordinance, and <br />pointed out that in the conceptual site plan consideration was <br />given to the upland preservation issue by planning an additional <br />40 -foot buffer. Another justification for this expansion is taking <br />advantage of internal capture and mitigating the impact to the <br />intersection of U.S.1 and Roseland Road; once the customer is on <br />site they can pretty much do all their shopping without impacting <br />the public road system adversely, or at least to a minimum. Mr. <br />Mayfield discussed the available and planned utilities and how the <br />project would accelerate improvements to both the water and <br />wastewater facilities. He discussed the creation of the node in <br />1986 by the County Commission and adoption of the same node into <br />the 1990 Comp Plan without further review with regard to what has <br />occurred in the node since that time. Several new facilities, Sand <br />Ridge Shopping Center, McDonald's, Harbor Federal and Bay Street <br />Center, have come on line since the node was created and he felt <br />this creates some changes in the circumstances of the node. <br />Mr. Mayfield mentioned several points of disagreement between <br />the applicant and staff which had been discussed and about which <br />staff had changed their position. This resulted in the removal of <br />the northwest portion of this site from staff's calculation of the <br />percentage of development. Another outcome of discussions with <br />staff was his determination that the 70% criterion would'become a <br />non -issue. <br />Chairman Bird asked if he was referring to the point made <br />regarding whether we have flexibility. <br />County Attorney Vitunac recounted that there was a meeting in <br />his office where the issue of flexibility in regard to the 70% was <br />discussed between himself, Assistant County Attorney Will Collins, <br />Community Development Director Bob Keating and Chief Long -Range <br />Planner Sasan Rohani, with Mr. Nobil and Mr. Mayfield representing <br />the other side. He felt staff is comfortable that the Board can <br />legally grant this if it wants to. <br />Director Keating agreed that if it is determined that the <br />hospital portion is developed and the node there is just a little <br />less than 70% developed the Board could approve it. <br />Attorney Barkett felt an important point to address is the <br />utilities and the fact that a wastewater package plant would be <br />removed and the River's Edge water treatment could be improved and <br />brought down to service the node, including Winn Dixie across the <br />30 <br />
