King <br /> President <br /> -- <br /> 92574 1h Avenue S W <br /> Vero Beach, Florida <br /> USA 32968-9702 <br /> Telephone: 772—562—9662 <br /> February 26, 2013 Fax:772—567-9557 <br /> Indian River County <br /> 1801 27th Street <br /> Vero Beach, Florida <br /> USA 32960-3365 <br /> Attention: Mr. Joseph Baird <br /> County Administrator <br /> Subject: INEOS New Planet BioEnergy and Indian River County Feedstock Supply Agreement — <br /> Request to Extend use of County Scales and Property and Alignment of Operating Hours <br /> Dear Mr. Baird: <br /> I am following up on our discussion to extend the use of the County Scales and IRC property for the <br /> processing of Vegetative Waste per the Feedstock Supply Agreement between INEOS New Planet <br /> BioEnergy LLC (INPB) and the Indian River County Solid Waste Disposal District signed June 2, 2011, <br /> . and specifically the Third Amendment to the Agreement approved by the Board of County <br /> Commissioners November 13, 2012 in attachment. <br /> INPB respectfully requests to extend the temporary license to occupy and use the District's Vegetative <br /> Waste Management Area from April 30, 2013 to May 31St, 2013. <br /> INPB respectfully requests the extension of the use of the County Scales to include $3.00 for each out of <br /> county vehicle through April 30, 2013 and$3.00 for each vehicle after April 30, 2013. <br /> Additionally, INPB respectfully requests to change the operating hours noted in the Feedstock Agreement <br /> Section 3.LB.2 indicated as 6 a.m. to 6 p.m. to align with the Landfill's existing hours of operation 7 a.m. <br /> to 5 p.m.. <br /> We believe that the above extensions and alignment with present landfill hours of operation will help to <br /> ensure a smooth transition to INPB's reception and processing operations, both operationally as well as <br /> from a public communications standpoint, and have already initiated discussion with the SWDD in this <br /> regard. <br /> Please contact me with any questions that you or Staff may have relating to this request and any additional <br /> actions required by INPB in order to have these requests approved. <br /> Best regards, <br /> David King, President <br /> INEOS New Planet Bio nergy LLC 272 <br /> 72 <br />
