Polackwich, Sr., County Attor j;, <br /> DATE: May 28, 2013 <br /> SUBJECT: Proposed Third Amendment to Facility Lease Agreement for Vero Sports Village <br /> BACKGROUND. <br /> On May 1, 2009, the County leased the former Dodgertown facilities to Minor League Baseball, through <br /> its subsidiary MiLB Vero Beach, LLC ("MiLB"). The Facility Lease Agreement ("FLA") was for a five <br /> " year term, ending April 30, 2014, with two five year renewal options. The FLA has been amended on two <br /> prior occasions,the latest of which is dated January 1, 2012, in which the County approved the assignment <br /> of the FLA to Verotown, LLC, whose managing member is Peter O'Malley. <br /> After several months of staff negotiations, and extensive discussions at two Board of County <br /> Commissioners' meetings, staff and Verotown have reached agreement on the terms of renewal of the <br /> FLA, which are set forth in the attached Third Amendment to Facility Lease Agreement ("Third <br /> Amendment"). The Third Amendment is, of course, subject to Board approval —which is the purpose of <br /> this agenda item. <br /> DISCUSSION AND ANALYSIS. <br /> The Third Amendment contains several material changes from the FLA, as follows: <br /> • The County agrees to pay up to $600,000 to renovate the remaining 67 of the 89 hotel rooms <br /> which have not yet been renovated <br /> Indian River Co.
