Polackwich, Sr., County Attorney�`� <br /> DATE: May 28, 2013 <br /> SUBJECT: Proposed Natural Gas Franchise Agreement- Permission to Advertise for Public Hearing <br /> BACKGROUND. <br /> •�.. On May 7, 2013, the Board of County Commissioners adopted an ordinance requiring that natural gas <br /> distributors operating within the unincorporated county obtain a franchise agreement and pay a franchise <br /> fee. The ordinance takes effect on July 1, 2013. <br /> Currently, there is one natural gas distributor operating with the unincorporated county — Pivotal Utility <br /> Holdings, Inc., a New jersey corporation doing business as Florida City Gas ("FCG"). Staff is currently in <br /> negotiations with FCG with respect to a franchise agreement. It is expected that a proposed agreement <br /> will be ready for Board consideration and approval at the June 18, 2013 meeting. <br /> Meanwhile, chapter 59-1380, Laws of Florida, which is a special act of the Florida Legislature dealing <br /> with franchises in Indian River County, requires that a public hearing be held before the Board grants a <br /> new franchise. <br /> Accordingly, the County Attorney requests permission to advertise for a public hearing on June 18, 2013, <br /> to consider granting a franchise to FCG to distribute natural gas within the unincorporated county. <br /> Indian River Co.
