DeBraal, Deputy County Attorne <br /> DATE: , July 9, 2013 <br /> SUBJECT: Approval of Expert Witness Fees for William Bethel: Parcel 108 <br /> Background On March 17, 2009 the Board approved a Resolution of Necessity for a <br /> parcel of property located at 4875 66th Avenue, owned by William Bethel. This parcel <br /> lies on the west side of 66th Avenue between 45th Street and 49th Street. The property <br /> is approximately 0.89 acres in size and contains a three bedroom, two bath house of <br /> approximately 1,732 sq. ft. The road construction plans for 66th Avenue call for the <br /> County to acquire 0.30 acres of property from Mr. Bethel for road right-of-way along 66th <br /> Avenue. <br /> The matter proceeded to a five day jury trial and the jury returned a verdict of $305,000 <br /> for full and final compensation to Mr. Bethel for all damages as a result of the taking. <br /> Mr. Bethel appealed the verdict to the Fourth District Court of Appeal. The Appellate <br /> Court affirmed the verdict without an opinion. The only matter left to resolve is the <br /> payment of Mr. Bethel's expert witness fees and costs, which, by statute, the <br /> condemning authority is obligated to pay. <br /> indianRiverCo.
