DeBraal, Deputy County Attorney <br />DATE: July 2, 2013 <br />ATTORNEY <br />SUBJECT: Approval of Agreement to Purchase and Sell Parcel 108 <br />Estate of Earl Hobbs, Jr., 6420 491h Street, Vero Beach <br />On March 5, 2013, the Board extended an unconditional offer to the Estate of <br />Earl Hobbs, Jr. to purchase a 1.467 acre parcel of property to be used as right- <br />of-way for the 66th Avenue improvement project. The offer also included a <br />0.0746 acre temporary construction easement. The Board offered to purchase <br />the properties for $100,000. A resolution of necessity was approved at the same <br />meeting. <br />Mr. Hobbs passed away in January 2013 and part of his estate is comprised of a <br />33.159 acre parcel of property located at the northeast corner of 66th Avenue and <br />49th Street. The property is located outside the urban service boundary and is <br />zoned A-1 Agricultural. The parcel contains a single family house together with a <br />detached garage, detached carport and shed. None of the structures are <br />affected by the take. <br />The Hobbs Estate has accepted the purchase price offered for the property and <br />easement. They have asked for payment of attorney's fees in the amount of <br />$5,250 which is equal to 5.25% of the purchase price and $1,350 for engineering <br />fees. Both fees are deemed reasonable by this office. In coordinating the <br />approval of the purchase with the Estate, they have asked for the dirt excavated <br />from the new drainage swale to be left on the remainder parcel and that the <br />grade of the new driveways not exceed 5% slope.
